Limited Use Label License: Terms of Use for Viral Vectors

TERMS OF USE FOR VIRAL VECTORS

Any virus provided to you, as a part of Addgene’s Viral Services, remains subject to the terms and conditions under which you are receiving, or have received, the applicable plasmid, including the Uniform Biological Material Transfer Agreement (UBMTA) and any ancillary agreements or limited use label licenses. Without limiting the foregoing, such terms and conditions provide that the virus shall at no time be: (a) used for commercial purposes (as defined in the UBMTA); or (b) used in human subjects, in clinical trials, or for diagnostic purposes involving human subjects.

BIOSAFETY LEVEL 2. In engaging Addgene’s Viral Services, you acknowledge that the services and material provided herein are experimental in nature. You understand that biosafety level 2 (BSL2) materials, such as virus, under certain circumstances, present a moderate risk and may have biological and/or chemical properties that are unpredictable and unknown at the time of transfer. By acknowledging these terms, you agree that such materials will be used with caution and prudence, pursuant to BSL2 guidelines.

ADDGENE MAKES NO REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY KIND REGARDING VIRAL SERVICES PROVIDED HEREIN. THERE ARE NO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THAT VIRUS PROVIDED THROUGH THESE SERVICES WILL NOT INFRINGE ANY PATENT, COPYRIGHT, TRADEMARK OR OTHER PROPRIETARY RIGHT.
